The Survey For Alcohol Compliance is an inspection program where Excise officers accompany youth aged 18-20 into licensed alcoholic beverage establishments where the youth attempt to purchase alcoholic beverages.
If a clerk rings up the alcoholic beverages and money is exchanged, it’s a “sale”. If a server in a restaurant delivers the drink to the table, it is considered a sale. Youth do not carry any identification during the inspections. If the Sale of an Alcoholic Beverage is made to a minor, a violation is issued against the business and owner faces up to $1,000 fine from ATC.

BAC to be found legally intoxicated to operate a vehicle in Indiana is .08%. However, a person can be arrested for OWI with a much lower BAC if he/she is showing signs of intoxication.

It is unlawful for a person to sell, barter, deliver, or give away an alcoholic beverage to another person who is in a state of intoxication if the person knows that the other person is intoxicated.

The statute does not mention anything about “mode of transportation”. “Designated Drivers” do not lessen your responsibility to stop serving someone who is showing signs of intoxication. If all else fails, contact law enforcement . You must not serve anyone to a point of intoxication regardless of how he/she arrived at your business, including walking!

- Over-the-Counter Medications
- Illegal Substances
- Medical Conditions.

Train employees in responsible serving techniques. Encourage clerks to contact management when problems arise.Watch your patrons for common signs of intoxication. Refuse service when appropriate, even if the signs of intoxication have not yet become overtly obvious.
Refuse to allow intoxicated patrons into the premises. Refuse alcohol sales to persons known to have problems with intoxication. Refuse entry to persons who create problems.
Always take time to note any signs of intoxication from your initial contact. Take steps to ensure safety of patrons who have over consumed. Servers need to remain calm & professional, which can be difficult in these stressful situations. Train servers to know that if a patron is being unruly, to get management involved. Contact law enforcement when public safety becomes a concern.
Remember, it is not against the law for employees to consume alcoholic beverages while on duty. However, it is against the law for any employee to be in a state of intoxication in a public place.

Dram shop or dramshop is a legal term in the United States referring to a bar, tavern or the like where alcoholic beverages are sold. Traditionally, it referred to a shop where spirits were sold by the dram, a small unit of liquid.
Dram shop liability refers to the body of law governing the liability of taverns, liquor stores and other commercial establishments that serve alcoholic beverages. Generally, dram shop laws establish the liability of establishments arising out of the sale of alcohol to visibly intoxicated persons or minors who subsequently cause death or injury to third-parties (those not having a relationship to the bar) as a result of alcohol-related car crashes and other accidents.
The laws are intended to protect the general public from the hazards of serving alcohol to minors and intoxicated patrons. Groups such as Mothers Against Drunk Driving (MADD) have advocated for the enforcement and enactment of dram shop laws across the United States as well as in the United Kingdom, Canada, New Zealand and Australia. The earliest dram shop laws date from the 19th century temperance movement.
The laws have drawn criticism by those who claim they downplay the role of personal responsibility.

Bloodstream is the blood circulating through a person’s body. When alcohol is swallowed, small amounts directly enter the bloodstream through capillaries (tiny blood vessels) in the mouth. In the stomach, close to 20 percent of alcohol can be absorbed directly into the bloodstream. The remaining 80 percent passes to the small intestines where it is absorbed into the bloodstream.
Once in the bloodstream, alcohol rapidly spreads through the entire body. Within 3 minutes of beverage alcohol consumption. The brain accurately determines the amount of alcohol in the bloodstream. A breathalyzer accurately measures a person’s blood alcohol content or concentration (BAC- is the percentage of alcohol absorbed into the bloodstream) by testing his or her breath.
The liver metabolizes alcohol at a constant rate- about one drink per hour. Un-metabolized alcohol continues to circulate through the bloodstream and can affect the drinker’s mood and behavior.
Alcohol is classified as a depressant. Some of the ways it affects the body are by-
- Depressing various brain functions.
- Alcohol is absorbed from all parts of the gastrointestinal tract. It passes from the blood into nearly every tissue in the body, including the brain.
- Alcohol is a diuretic, helping the body lose fluids and cause thirst.
- Alcohol is a vasodilator, causing the small blood vessels on the surface of the skin to dilate or swell, making the body lose heat.
Thus Alcohol in a human body can cause:
- Relaxed Inhibitions. An inhibition is a mental or psychological process that retrains or suppresses a person’s emotions, actions or thoughts.
- Hypoglycemia- a decrease of sugar in the blood.
- Digestive Changes- alcohol initially increases the appetite, but eventually decreases it.
In addition to the physical problems alcohol can cause there are also Behavioral Signs Of Alcohol Absorption. These include-
- Significant Changes in Behavior.
- Relaxed Inhibitions
- Impaired Judgment.
- Slowed Reaction Time
- Impaired Motor Coordination.

- AMOUNT OF ALCOHOL CONSUMED: Drinks that contain more than one serving of alcohol should be counted as two or more drinks. Count the amount of alcohol, not the drink.
Composition of Drinks
Each of the following drinks contain about ½ ounce of alcohol:
- 12 ounce glass of beer.
- 4.5 ounces of 12% table wine
- A straight drink (only beverage alcohol) or a mixed drink with 1.5 ounces of 80 proof liquor. Or 1.0 ounce of 100 proof liquor.
- They all have approximately the same alcohol content ! !
- TIME- Consuming more than one drink per hour will increase the amount of alcohol absorbed into the bloodstream. Burn off rate = approximately 1 drink per hour. Cold showers and coffee DO NOT sober up a person.
- FOOD: Fatty and high protein food slow the absorption of alcohol into the small intestine.
- WATER: Water dilutes alcohol and relieves thirst.
- CARBONATION: Carbonation speeds alcohol’s absorption into the bloodstream.
- BODY SIZE: A large person can consume more beverage alcohol and take a longer time to react to that alcohol than a small person.
- FAT-TO-MUSCLE RATIO: A person with more body fat will become intoxicated by drinking less beverage alcohol than a person with less body fat.
- GENDER: Women tend to become intoxicated more quickly and with less beverage alcohol than men.
- RAPID OR ERRATIC ABSORPTION- High Risk Individuals:
- Stress, depression, dieting and fatigue can affect the absorption of alcohol into the bloodstream. The effects can be delayed or immediate, but the reactions are always strong.
- Altitude can increase the effects of alcohol. Especially true for those individuals not use to higher altitude areas.
- Tolerance is the ability to endure the effects of alcohol without exhibiting the usual symptoms. Long time drinkers (or alcohol abusers) can build up tolerance to the effects of alcohol.
You cannot tell how much alcohol is in a person’s system by just looking at them. Depending on gender and tolerance levels, each person will show signs of intoxication after a different number of drinks. Medications can strongly influence the effects of alcohol by magnifying the impact of both the drug and the alcohol. This can occur with a little as one drink. Mixing alcohol with sedatives will multiply the sedative effects of both drugs and slow the central nervous system. Mixing alcohol with marijuana can decrease motor control and mental concentration.

In Indiana hours of service are Sunday – Saturday- 7:00AM – 3:00AM. All bar service must be cleared 30 minutes after legal serving time ends. The only day when sale is Unlawful is Christmas Day. No carry out or on premises consumption.
On Election Day* you may serve alcoholic beverages both on premise and for off premise consumption from 7:00am – 3:00am. (Effective March 2010).
